Off Grid Market — Terms of Service

These Terms of Service ("Terms") form a binding contract between you and Off Grid Market LLC ("Off Grid Market," "we," "us," or "our"). Please read them carefully. By creating an account, you agree to these Terms and to our Liability Waiver and Release.

1. Who can use Off Grid Market

You must be at least 18 years old and able to form a legally binding contract. By creating an account, you represent that you meet these requirements. We may refuse service, close accounts, or cancel listings at our sole discretion.

2. Off Grid Market is a marketplace, not a service provider

Off Grid Market is an online venue that connects buyers, sellers, hosts, guests, service providers, employers, and applicants. We do not own, operate, manage, control, host, or supervise any property, product, service, expedition, or job posted on the platform. All transactions are directly between users.

When you book a stay, hire a service, buy a product, or post a job, you are doing so with the third-party user who created the listing — not with Off Grid Market.

3. Your account

You are responsible for all activity on your account and for keeping your password secure. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Listings, content, and conduct

You agree NOT to:

Post anything illegal, infringing, fraudulent, harassing, defamatory, hateful, sexually explicit, or deceptive.
Use the platform to spam, scrape, automate, or reverse engineer.
Misrepresent yourself, your listings, or your prices.
Circumvent our payment or commission systems.
Post firearms, controlled substances, hazardous materials, or other items prohibited by federal or state law.
List anything you do not have the right to sell or rent.

We may remove any content and suspend any account at our discretion. You grant Off Grid Market a worldwide, royalty-free license to display, distribute, and promote your listings on the platform and in our marketing.

5. Fees and payments

We charge commissions, service fees, and subscription fees as disclosed in your dashboard at the time of the transaction. Fees may change with 30 days' notice. Payments to sellers and hosts are processed through Stripe Connect; you agree to Stripe's terms as well.

6. Refunds and disputes

Refunds for bookings are governed by the host's cancellation policy (Flexible, Moderate, or Strict) shown on each listing. Refunds for products are governed by the seller's stated return policy. Off Grid Market is not a party to refund disputes between users; we will provide reasonable assistance but are not obligated to intervene.

7. Disclaimers

Off Grid Market is provided "AS IS" and "AS AVAILABLE." We make no warranties about the platform, the listings, the users, or any transaction. We do not verify users' identity, qualifications, licenses, insurance, safety practices, or the accuracy of any listing.

8. Limitation of liability

To the fullest extent permitted by law:

Off Grid Market is not liable for any indirect, incidental, consequential, special, or punitive damages.
Our total liability to you for any claim is capped at the greater of (a) the fees you paid Off Grid Market in the 12 months preceding the claim, or (b) $100.
This applies to all claims, whether contract, tort, statutory, or otherwise.

9. Indemnification

You agree to defend, indemnify, and hold harmless Off Grid Market, its officers, employees, and contractors from any claim arising from your use of the platform, your listings, your transactions, your content, or your violation of these Terms.

10. Governing law and dispute resolution

These Terms are governed by the laws of the United States and the state in which Off Grid Market LLC maintains its principal place of business, without regard to conflict-of-laws principles. You and Off Grid Market agree to resolve any dispute through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive any right to participate in a class action. If the arbitration provision is found unenforceable, exclusive venue lies in the state and federal courts of the jurisdiction in which Off Grid Market LLC maintains its principal place of business.

11. DMCA / copyright

We respect intellectual property rights. If you believe content on the platform infringes your copyright, send a DMCA notice to dmca@offgridmarket.net with the items required by 17 U.S.C. § 512(c)(3). Repeat infringers will be terminated.

12. Changes to these Terms

We may update these Terms at any time. When we do, we will re-prompt you to accept the new version. Continued use of the platform after the new version's effective date means you accept it.

13. Termination

You may close your account at any time from your dashboard. We may suspend or terminate your account at any time for any reason. Sections 4, 5, 8, 9, and 10 survive termination.
