Off Grid Market — Liability Waiver and Release
This is a legal document. By checking the box and typing your full legal name, you are waiving substantial legal rights. Please read it carefully. If you do not understand any part of it, do not sign — consult an attorney first.
1. The activities you may encounter
Off Grid Market connects you with third-party hosts, sellers, guides, instructors, employers, and other users who offer activities that may be physically demanding, take place in remote or wilderness areas, lack access to medical care or cell service, involve animals or firearms, or otherwise carry inherent risks of injury, illness, property loss, or death. Examples include but are not limited to:
- Off-grid cabin, RV, tent, and primitive lodging
- Hunting and fishing expeditions
- Survival and bushcraft training
- Pack mule, horseback, and wilderness travel
- Solar, well, septic, and off-grid infrastructure work
- Agricultural and farm labor
2. Assumption of risk
You knowingly and voluntarily ASSUME ALL RISKS, known and unknown, associated with any listing or activity you access through Off Grid Market, including risks caused by the negligence of any party.
3. Release of Off Grid Market
You RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Off Grid Market LLC, its officers, employees, agents, affiliates, and contractors (collectively the "Released Parties") from any and all claims, liabilities, damages, costs, or expenses arising out of or related to:
- Any listing, booking, transaction, or interaction with another user on the platform;
- Any injury, illness, death, property loss, theft, or damage you suffer in connection with using the platform;
- Any act or omission by another user, including a host, seller, service provider, guide, employer, or applicant;
- Any failure of safety equipment, infrastructure, or premises provided by another user;
Even if caused in whole or in part by the negligence of the Released Parties, to the maximum extent permitted by applicable law.
4. Off Grid Market is not an insurer
Off Grid Market does not provide insurance for you, your trip, your property, or your activities. You are solely responsible for obtaining your own health, travel, property, accident, liability, or other insurance appropriate for the activities you choose. We strongly recommend you do so.
5. Indemnification
You agree to defend, indemnify, and hold harmless the Released Parties from any third-party claim arising from your use of the platform or your participation in any listing or activity.
6. Acknowledgment of off-grid conditions
You acknowledge that listings on Off Grid Market may be in locations without electricity, running water, cell service, or quick access to emergency services. You agree to evaluate your own fitness, preparation, equipment, and risk tolerance before booking or attending any activity.
7. Severability and survival
If any portion of this Waiver is held unenforceable, the rest remains in full effect. This Waiver survives the closure of your account.
8. Governing law
This Waiver is governed by the laws of the state in which Off Grid Market LLC maintains its principal place of business. Venue and arbitration follow the Terms of Service.
9. Your acknowledgment
By checking the box, typing my full legal name, and clicking "I Agree," I certify that:
- I have read this Waiver in full;
- I understand it releases substantial legal rights;
- I am at least 18 years old and signing voluntarily on my own behalf;
- The name I type below is my legal signature for purposes of the E-SIGN Act and applicable state e-signature law.
